1. Enquiry and acceptance
An enquiry starts a discussion only. It does not guarantee acceptance, availability, price or a delivery date. A paid commission begins only after NDev Studios issues a written proposal or quotation, the client accepts the relevant terms in writing and the required initial payment has cleared.
3. Scope and specification
The accepted proposal defines the approved scope, exclusions, deliverables, expected schedule, payment stages, included revisions and support period. Work outside that scope is not automatically included.
4. Client responsibilities
The client must provide accurate requirements, lawful materials, suitable access and timely decisions. Credentials should be shared only when necessary, limited where possible and replaced after handover where appropriate.
5. Revisions and scope changes
Up to two grouped revision rounds are included for changes within the approved scope. Covered bug fixes do not consume revision rounds. Additional rounds, new features, substantial redesigns or expanded requirements require a written scope change, separate quotation or new commission before that work begins.
6. Communication and approval
Written decisions through the official project communication channel, including the project Discord channel where used, may be recorded as approval of scope, revisions, milestones, testing outcomes, delivery or support activation. Clients should review requested approvals carefully before confirming them.
7. Testing, approval and delivery
NDev Studios tests commissioned work against the approved requirements before client review. After final approval and cleared final payment, the agreed product is delivered or deployed with the files, documentation and setup material listed in the accepted proposal.
8. Ownership and reusable knowledge
After final payment, the client receives the agreed completed product and agreed deliverables. NDev Studios may retain general knowledge, techniques and independently developed reusable components. Client branding, private data, credentials, confidential information and client-specific assets are not reused without permission.
9. Retention and confidentiality
Project backups are kept during the included support period and may be retained for seven additional days before deletion unless continued retention is agreed. Commissions are not automatically published; portfolio use requires explicit agreement, and confidentiality does not carry an automatic extra charge.
10. Inactivity
If a required client response is not received for 14 days, development may be paused. After 30 days, NDev Studios may close the commission following written notice. Restarting is subject to current availability and may require a revised schedule.
11. Cancellation and refunds
Cancellation and refund treatment follows the Payments and Cancellations Policy. Before development begins, payments received for that commission are refunded in full. After work begins, only a fair and proportionate amount for work performed, committed time, direct costs or genuine losses may be retained, with any unearned amount refunded.
12. Mandatory rights
Nothing in these terms is intended to remove rights or remedies that cannot lawfully be excluded. Commission-specific terms and required pre-contract information are supplied in a form the client can keep before payment where required.
